Welcome to Agnes Water Surf website (the “Site”). By accessing, registering an account, submitting listings, purchasing pro listings, adding events, or otherwise using the Site, you agree to these Terms and Conditions (“Terms”). If you do not agree, cease use immediately.

1. Definitions

  • We/Us/Our: The operators of the Site.
  • You/User: Any visitor, account holder, or submitter.
  • Listings: Business or service directories, including free and pro (paid) versions.
  • Events: Free public event submissions, focused on surfing, beach activities, or select annual music events in the Agnes Water region.

2. Account Registration

Create an account to submit listings or events. You must provide accurate details and keep them updated. You are responsible for maintaining confidentiality of your login credentials. Notify us promptly of unauthorised access. We may suspend or terminate accounts for breaches of these Terms.

3. Free Listings

Users may submit free listings for basic directory inclusion. Submissions must relate to surfing, beach activities, or the Agnes Water region. We reserve the right to:

  1. Review and Approve: Edit, modify, or reject any free listing at our discretion for clarity, relevance, appropriateness, or accuracy.
  2. No Guarantee: Submission does not ensure publication, prominence, or ongoing visibility. Listings may be deprioritised or removed without notice.
  3. Content Responsibility: You warrant all information is accurate, non-misleading, and complies with Australian laws. You bear sole liability for errors or claims arising from your listing.
  4. Moderation: Offensive, illegal, or off-topic content will be declined or deleted. We prioritise community-aligned submissions.

Free listings offer limited features; no refunds apply as no payment is involved.

4. Pro Listings

Paid upgrades enhance visibility (e.g., priority placement, images). Payments via secure third-party providers. Fees non-refundable except under Australian Consumer Law.

We may edit, reject, or remove pro listings for the same reasons as free ones, without refund.

5. Payments and Refunds

Pro listings require payment upfront. Prices are in AUD and include GST where applicable. We use Stripe or similar for transactions; review their terms separately.

Refunds: Only if the service is not provided as described, per Australian Consumer Law. No refunds for user error or changed mind. Chargebacks may lead to account suspension.

6. Free Events Submissions

By submitting an event to this public event page, you acknowledge and agree to the following terms and conditions:

  1. Relevance & Location: Events must be directly related to surfing or beach activities in the Agnes Water region. Exceptions may be made for recognised annual music events. Any submissions that do not adhere to these themes may be edited or rejected at our discretion.
  2. Editing & Moderation Rights: We reserve the right to edit, modify, or decline any event submission if we determine it does not align with the interests of our visitors or our site’s mission. This includes, but is not limited to, adjustments for clarity, appropriateness, or accuracy of the information provided.
  3. No Guarantee of Listing: Submission of an event does not guarantee its publication or visibility on our page. We reserve the right to prioritise and select events that best reflect the interests of the community and add value to our audience.
  4. Compliance with Local Laws: All submitted events must comply with local regulations, including obtaining the necessary permits, licenses, or permissions for public events or gatherings. Organisers bear full responsibility for ensuring legal compliance.
  5. Event Information Accuracy: You are solely responsible for the accuracy and truthfulness of the information provided in your submission. Misleading or false information may lead to rejection or removal of your event without notice.

By submitting an event, you agree to these terms and acknowledge that the final decision regarding the publication or modification of events lies solely with us.

7. User Conduct

No spam, harassment, malware, scraping, or automated access. Respect intellectual property.

8. Intellectual Property

You grant us a non-exclusive, royalty-free licence to use, display, and modify submitted content for Site purposes. You retain ownership but warrant you have rights to submit.

Site content (text, images, code) is our property or licensed. No reproduction without consent.

9. Disclaimers and Liability

The Site is provided “as is”. We disclaim warranties of fitness or uninterrupted access. We are not liable for user content, event outcomes, or third-party links.

Liability limited to the maximum extent under Australian law. No indirect damages.

10. Termination

Access terminable anytime. Request account deletion via contact page.

11. Governing Law

These Terms are governed by Queensland, Australia laws. Disputes resolved in Queensland courts.

12. Changes

We may update Terms; continued use implies acceptance. Check regularly.
